Ans : Technically HP has to be removed from RC before transfer of ownership of bike. However, process for HP termination and transfer of ownership can be done together. So, just get the loan closure letter and NOC from bank required for HP termination. Submit these papers along with ownership transfer documents to the RTO.
Do sellers presence is required in Chennai RTO for the transfer of car ?
Ans : Physical presence of seller is not required at RTO for the transfer of ownership of vehicle. Physical presence is required only in case where there is signature mismatch of the seller with the signature sample in the RTO record.
What is the procedure to transfer ownership of vehicle in case of death of registered owner ? Also what is the rule regarding nominee in RC ?
Ans : The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.
Before the new amendment took place, transferring a car to a nominee in the event of the death of the registered owner of a vehicle requires complying with a cumbersome procedures and frequent visits to different offices. The process was not uniform across the country.
When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.
Further, to transfer the vehicle in his or her name, the nominee will have to apply in form 31 within the period of three months from the death of the owner of the motor vehicle.
In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.
βThe person referred to in sub-rule(1) shall apply in Form 31 within the period of three months to the said registering authority for the transfer of ownership of the vehicle in his name accompanied by:-

Ans : Under the provisions of section 52 of Motor Vehicle Act, the alteration of Motor Vehicle is allowed after prior permission of registering authority. What if the fitness of the vehicle is expired?
Ans: Private vehicles in India such as car and motor cycle have fitness which is valid for 15 years. After completion of 15 years they need to renew fitness of the vehicle.
For fitness , one need to apply for fitness renewal in the concerned RTO where vehicle is registered. RTO inspector do inspection of the vehicle and if found fit for driving on road , it issues fitness certificate for another 5 years.

Is form 35 and NOC the same?
Ans : No. Form 35 and NOC are not the same . NOC is given by the financer once you repay the loan on vehicle completely. It is stated in the NOC that loan has been closed and bank has no objection in the removal of hypothecation from the RTO record against the said vehicle.
Form 35 is the RTO application form used for the hypothecation termination from the RTO record of the vehicle.2 sets of form 35 is to be submitted in the RTO for hypothecation cancellation along with supporting documents. This form 35 should be signed by both bank as well as registered owner.
How much road tax refund will I get from the parent RTO, in the case where I am moving my vehicle out of the state ?
Ans : You will get road tax refund for the remaining period from the date of issue of NOC, on pro-rata basis.
Vehicle road tax for private vehicle is paid for 15 years. Suppose you are moving your vehicle from Bangalore to Pune after 5 years from the date of registration. You are entitled to get refund of road tax for 10 years of unused period on pro-rate basis.
Do I need to visit RTO for duplicate RC process ?

Ans : For RC transfer valid insurance is required. It can be either in the name of seller or buyer , doesn't matter.
