​​​I want to sell my bike. Its Chennai registered and there was hypothecation on it. Do I need to cancel HP before selling bike ?

Ans : Technically HP has to be removed from RC  before transfer of ownership of bike. However, process for HP termination and transfer of ownership can be done together. So, just get the loan closure letter and NOC from bank required for HP termination. Submit these papers along with ownership transfer documents to the RTO.  


Do sellers presence is required in Chennai RTO for the transfer of car ?   

Ans : Physical presence of seller is not required at RTO for the transfer of ownership of vehicle. Physical presence is required only in case where there is signature mismatch of the seller with the signature sample in the RTO record.

What is the procedure to transfer ownership of vehicle in case of death of registered owner ? Also what is the rule regarding nominee in RC ?

 Ans : The Ministry of Road Transport and Highways has made a few changes to the central motor vehicle rules of 1989 to make it easier for people who want to nominate a person in their vehicle registration certificate.

Before the new amendment took place, transferring a car to a nominee in the event of the death of the registered owner of a vehicle requires complying with a cumbersome procedures and frequent visits to different offices. The process was not uniform across the country.

When the owner of a motor vehicle dies, the person nominated on the registration certificate by the deceased or the person who succeeds to the ownership of the car can use the vehicle as his or her own for three months after the owner's death. For this, the individual must notify the registering authorities of the owner's death within 30 days of the death's occurrence.

Further, to transfer the vehicle in his or her name, the nominee will have to apply in form 31 within the period of three months from the death of the owner of the motor vehicle.

In case where the owner wants to change the nominee of the motor vehicle in case of contingencies like divorce or division of property, she/he may change the nomination.

​The person referred to in sub-rule(1) shall apply in Form 31 within the period of three months to the said registering authority for the transfer of ownership of the vehicle in his name accompanied by:-

• The appropriate fee as specified in rule 81;
  
• The death certificate in relation to the registered owner;
  
• The certificate of registration;
  
• The certificate of insurance;
  
• Driving License and permit in case of E-rickshaw and E-cart.
  

My driving licence was issued from Bangalore. It has been expired. Currently I am in Chennai. Can I renew my driving licence from Chennai RTO?

Ans : Yes, You can renew your driving licence from Chennai. 

Who are eligible for permanent licence ? 

Ans : Following are the eligibility criteria for a permanent licence : 

• You should have a valid learner licence.
• You should apply after 30 days and within 180 days from the date of issuance of learner licence.

Can I alter the motor vehicle?

Ans :  Under the provisions of section 52 of Motor Vehicle Act, the alteration of Motor Vehicle is allowed after prior permission of registering authority. If registering authority feels the sufficient ground to alter the vehicle, the permission is granted. The conversion like from fuel Petrol to C.N.G. is also allowed after the permission in case of engine assembly.

​How should I prepare for the driving test? 

Ans:  Apart from the obvious driving skills, you will be tested on your ability to maneuver your vehicle in a crowded area. The theoretical part of the test pertains to your ability to recognize road signs, simple queries about the assemblies and about signals, sensors, and indicators of vehicle system.

I have purchased a used car in Chennai. Its registered in Coimbatore. I live in Ambattur.  Do I need NOC from Coimbatore RTO for this ?

Ans : To transfer ownership of  car in Chennai  which is originally registered in Coimbatore, NOC from Coimbatore RTO is required in the name of buyer .

I have purchased a second hand bike in Chennai and received all the necessary papers from the seller . Within how much time I should submit documents in the RTO office for transfer of ownership ?

Ans : The documents and forms for transfer of ownership should be submitted to the concerned RTO within 30 days from the date of purchase of the bike. Failing which you will have to pay Rs. 300 late fine per month . For car this fine is Rs. 500 per month.

Can I get DL without test in Chennai?

Ans : No. You can not get DL without test in Chennai. Driving licence test is mandatory to get driving licence. You will have to go through two types of driving test and clear it.

1. Theory test (questions related to traffic rules and road signs)
2. Practical test for driving skill

What if the fitness of the vehicle is expired?

Ans: Private vehicles in India such as car and motor cycle have fitness  which is valid for 15 years. After completion of 15 years they need to renew fitness of the vehicle. 

For fitness , one need to apply for fitness renewal in the concerned RTO where vehicle is registered. RTO inspector do inspection of the vehicle and if found fit for driving on road , it issues fitness certificate for another 5 years. 

Is local address proof mandatory for RC transfer? If yes, what are the documents acceptable as address proof?

Ans : Local address proof is mandatory for RC transfer.

The documents which are acceptable as address proof for RC transfer are :

Is form 35 and NOC the same?

Ans : No. Form 35 and NOC are not the same . NOC is given by the financer once you repay the loan on vehicle completely. It is stated in the NOC that loan has been closed and bank has no objection in the removal of hypothecation from the RTO record against the said vehicle.

Form 35 is the RTO application form used for the hypothecation termination from the RTO record of the vehicle.2 sets of form 35 is to be submitted in the RTO for hypothecation cancellation along with supporting documents. This form 35 should be signed by both bank as well as registered owner.

How much road tax refund will I get from the parent RTO, in the case where I am moving my vehicle out of the state ?

Ans : You will get road tax refund for the remaining period from the date of issue of NOC, on pro-rata basis. 

Vehicle road tax for private vehicle is paid for 15 years. Suppose you are moving your vehicle from Bangalore to Pune after 5 years from the date of registration. You are entitled to get refund of road tax for 10 years of unused period on pro-rate basis.  

Do I need to visit RTO for duplicate RC process ?

Ans: Yes. One time visit of registered owner is mandatory for duplicate RC process in Chennai.

I have purchased a used car. Insurance of it has been expired. I am buying new insurance for RC transfer purpose. Insurance should be in the name of seller or buyer ?

Ans : For RC transfer valid insurance is required. It can be either in the name of seller or buyer , doesn't matter. However if you buy it in the name of seller later you will have to apply for insurance transfer in your name . Also if insurance is in the name of seller, you will not get claim for insurance in case of accident. So to avoid these complications its advisable to buy insurance in the name of new owner.

Can I drive my car in another state in India without NOC ?

 Ans : You can drive your car in another state in India without NOC only for short duration. If you have moved to other state permanently or planning to stay longer than 1 year its advisable to get NOC from the parent state and re-register your vehicle in the new state.

ROAD TAX REFUND from Chennai RTO
